Marc is an associate in the trade mark, designs and copyright team, having joined Bristows as a trainee in 2016. Marc advises on contentious and non-contentious matters relating to all “soft” IP rights, including trade marks, copyright and design rights, as well as advertising regulations. Marc specialises in complex intellectual property disputes and has broad litigation experience, handling significant cases before the Intellectual Property Enterprise Court, High Court and Court of Appeal, alongside trade mark registry proceedings before the UK Intellectual Property Office.

Highlights of Marc’s recent litigation experience include:

  • Walton v Verweij Fashion – Acting for the defendant in High Court trade mark infringement and passing off proceedings concerning a menswear brand.
  • Glaxo v Sandoz & Vectura – Representing Vectura in passing off proceedings brought by GlaxoSmithKline concerning the shape and colour of an asthma inhaler.
  • Natural Instinct Ltd v Natures Menu Ltd – Acting for the defendant in IPEC proceedings relating to sales of pet food in the UK and Europe.
  • Match Group v Muzmatch – Acting for the defendant in high profile and widely publicised trade mark infringement and passing off claims before the IPEC and Court of Appeal.
  • Virgin Enterprises v Heineken – Representing Heineken in a High Court trade mark infringement claim relating to alcohol free beer.
  • Chaos Boxing v Eriksson Bros – Acting for the defendant in IPEC proceedings relating to trade mark infringement and passing off claims concerning Playtech and e-sports equipment.
  • Newmark Real Estate & Co v Newmark Property Consultants – Acting for the claimant in High Court proceedings relating to a complex passing off claim seeking a declaration of non-passing off in connection with the provision of real estate services in the UK.

In addition to his litigation experience, Marc’s work includes handling alternative forms of dispute resolution, including acting for a global consumer electronics manufacturer in an ICC arbitration seated in London in connection with alleged breaches of a licensing agreement for the supply of semiconductor chips.

Marc has broad experience advising a diverse range of clients on contentious IP matters and pre-litigation strategy. Examples of Marc’s recent advisory work include:

  • Assisting a global confectionary company with the enforcement of registered trade mark rights against virtual goods featuring in the gameplay of an RPG on the Roblox platform.
  • Advising a leading Web3 digital media company regarding possible claims of trade mark and copyright infringement relating to the reproduction of a high-profile NFT collection.
  • Assisting a global fashion chain in connection with an international copyright dispute concerning the design of women’s lingerie.
  • Assisting a global fashion retailer with a cross-border registered design dispute relating to the shape and design of make-up sponges.

Marc also has experience assisting household brands with enforcement programmes to protect registered trade marks, copyright and design rights across a range of sectors, including media, fashion, and fast moving consumers goods. Additionally, Marc routinely advises advertisers and publishers regarding compliance with advertising regulations.

Marc regularly writes articles on key issues and developments within his practice area, including for Bristows’ Brands Review of the Year and Designs and Copyright Review of the Year plus contributions for several publications, including the European Intellectual Property Journal, The Licensing Journal, Kluwer Copyright Blog and World Intellectual Property Review, amongst others. He also presents on topics of interest, including webinars on the enforcement of intellectual property rights in the metaverse for Practical Law and the Society of Computers and Law, alongside presenting copyright and AI seminars for MBL.
